There is No Right to Medical Marijuana in Jail

Medical marijuana is illegal in jail

As of April 2023, 38 states allow the use of medical marijuana in the free community. However, on the federal level, marijuana is still an illegal drug. As a result, jails cannot allow marijuana in jail because it violates federal law.

If someone comes into jail with a legal prescription for medical marijuana, it cannot be honored. It should be communicated to the practitioner, who may prescribe a substitute medication on a patient-specific basis. Medical marijuana is illegal in jail.

Marijuana Use + Uncontrolled Vomiting or Psychosis = Hospital

The use of high-potency cannabis products may cause uncontrolled vomiting or psychosis. Psychosis is when an individual loses contact with reality. They may have difficulty recognizing what is real and what is not. This may include delusions or hallucinations. If a detainee is experiencing any of these symptoms, they should be sent to the hospital for evaluation and treatment. If a detainee uses marijuana and experiences uncontrolled vomiting or psychosis, send them to the hospital.
